Insurers Fight Steel Co.’s Offer of Coverage on Pollution Claims


Law360 (June 18, 2021, 5:12 p.m. EDT) – A group of CNA Insurance units sued Niagara LaSalle Corp. in Texas federal court, saying they had no obligation to defend the steel bar maker against two environmental repair claims involving the company’s alleged release of toxic materials.

Continental Casualty Co., Transportation Insurance Co., National Fire Insurance Co. of Hartford and Continental Insurance Co. said Thursday that they were not required to provide defense and indemnity to Niagara under the policies because a ” absolute exclusion of pollution “prohibits coverage.
